A practical guide for importers on BfArM's role, EU import authorisation, GMP expectations, documents and a checklist for vetting Indian suppliers.
Germany's Pharmaceutical Market: What Buyers Need to Know First
Germany is one of the largest and most heavily regulated medicine markets in Europe. Generics account for a large share of prescriptions, so demand for reliable, cost-competitive supply is steady. Entry is also demanding. Importers who want to import medicines from India to Germany must work within German law (the Arzneimittelgesetz, AMG) and the wider EU pharmaceutical framework. This guide explains who regulates what, which documents matter, and how to vet an Indian supplier.
Who Regulates What: BfArM, PEI and the Länder
Several bodies share responsibility in Germany:
- BfArM (Federal Institute for Drugs and Medical Devices): the main national authority for marketing authorisation of most human medicines, plus pharmacovigilance and risk assessment. It also handles national procedures and takes part in EU-wide procedures.
- Paul-Ehrlich-Institut (PEI): responsible for vaccines and biological products.
- State (Länder) authorities: they issue and supervise manufacturing and import authorisations and carry out GMP inspections at sites in their territory.
- European Medicines Agency (EMA): coordinates the centralised procedure and EU-level scientific assessment.
A generic can reach the German market through a national authorisation, the mutual recognition or decentralised procedure, or the centralised procedure. Your route depends on the product and the marketing authorisation holder (MAH). Confirm the current requirements directly with BfArM and the competent state authority before committing to a programme.
The Marketing Authorisation Question
In Germany, a medicine generally cannot be placed on the market without a valid marketing authorisation. The authorisation is held by an MAH established in the EU/EEA, not by the overseas manufacturer. For most importers and distributors, this means one of three scenarios:
- You hold, or intend to apply for, the marketing authorisation yourself, using a generic dossier supplied by the manufacturer.
- You distribute products already authorised under another MAH's licence, under a supply agreement.
- You source for a specific, legally permitted purpose, such as certain hospital or named-patient situations. Rules here are narrow and need legal review.
For scenario one, the manufacturer's data package must be in CTD format (Modules 1 to 5), with quality, stability and bioequivalence data suited to EU expectations. Tuli Enterprise can coordinate CTD dossier support and stability data from its manufacturing partners. Authorisation outcomes and timelines always rest with the regulator.
Import Authorisation and EU GMP
Medicines coming from outside the EU/EEA, including India, are subject to import controls. The key points are:
- Importer authorisation: the company that imports into Germany needs a manufacturing/import authorisation from the competent state authority.
- Qualified Person (QP): a QP in the EU/EEA must certify each batch before release, confirming that it was manufactured to EU GMP standards and matches the authorised dossier. This usually involves re-testing in the EU/EEA unless a valid arrangement exists.
- GMP compliance of the manufacturing site: the Indian site must meet EU GMP requirements. The authorities may rely on inspection history and an EU GMP certificate. A national export certificate alone is not a substitute.
Be sceptical of any supplier who says Germany will accept a product with only a basic certificate. A credible supplier will discuss EU GMP status, inspection history and QP release openly, and will name the sites involved.
Documents a German Importer Will Typically Request
Document packs vary by product and MAH, but a typical request includes:
- CTD dossier (Modules 1 to 5) and the current summary of product characteristics
- Certificate of Analysis (CoA) for each batch, with full test results
- Manufacturing site quality documentation and evidence of GMP compliance
- Certificate of Pharmaceutical Product (COPP) and Free Sale Certificate, as supporting export documents
- Stability data supporting the proposed shelf life and storage conditions
- Batch manufacturing and packaging records for QP review
- Transport and cold-chain documentation where relevant
- Commercial invoice, packing list and airway bill or bill of lading
Tuli Enterprise can supply COPP, CoA, CTD dossiers, Free Sale Certificates and stability data. Documents for each product are drawn from our manufacturing partners, who hold the relevant quality certifications. Tuli Enterprise itself acts as a merchant exporter and coordinator.
Labelling, Language and Serialisation
German-market packs must follow EU labelling rules. In practice:
- Labels and patient information leaflets must be in German and match the approved texts.
- Packs must carry the EU safety features required under the falsified medicines rules, including a unique identifier and an anti-tampering device, where the product category requires them.
- Pack presentations and pharmacy identification numbers must be agreed with the MAH in advance.
Labelling is much easier to get right when planned before production. Retrofitting a finished batch is costly and may not be permitted. If you need dedicated packs or a private-label presentation, see our contract manufacturing options.
Supplier Checklist for Indian Generic Medicines
Use this checklist when assessing any pharmaceutical exporter from India for the German market:
- Site transparency: does the supplier name the manufacturing site and allow audits?
- EU GMP evidence: can they show inspection history and current compliance status?
- Dossier readiness: is a CTD dossier available, with stability data under the right climatic zone conditions?
- Batch consistency: will they share CoAs and validation summaries across several batches?
- Packaging flexibility: can they handle German-language artwork and serialisation requirements?
- Supply continuity: what are the realistic MOQ and lead times? Tuli Enterprise confirms these per product, since they depend on the formulation, pack and order size.
- Pharmacovigilance cooperation: will they support safety reporting and recall procedures with your MAH?
- Clear Incoterms and payment terms: documented in writing before the first order.
Choosing Products and Planning Your First Order
Most importers begin with a narrow range where there is German demand and where a dossier can be prepared quickly. Browse our product catalogue or explore our range by therapeutic category to shortlist candidates. For a broader view of markets we serve, see countries we export to. Our other regulatory insights cover documentation and registration across more than 95 countries.
When you send an enquiry, include these details so we can respond with accurate information:
- Product name, strength and dosage form
- Annual volume estimate and first-order quantity
- Whether you hold a marketing authorisation or need dossier support
- Pack and language requirements
- Target delivery timeline
Realistic Expectations
Germany is not a market for quick, low-documentation trade. Success depends on the right MAH structure, an EU-compliant manufacturing site, clean documentation and careful labelling. Importers who treat the first product as a pilot, validating the supply chain before scaling, usually build the strongest long-term position. Regulations change, so verify current requirements with BfArM and your state authority at each stage.
